Who we are

Photostudio62 is a photo studio run by Arda and Sinem. We are responsible for the processing of personal data as described in this privacy statement.

What data we process and why

We only process data we need. Below you see, per purpose, which data this is and on what basis we process it.

Requesting or booking a shoot

Your name, email address, phone number, preferred date, the type of shoot and anything else you tell us, such as your child’s age or the due date. We use this to contact you, plan an appointment and carry out the shoot. Basis: performance of the agreement, or steps you ask for before entering into an agreement.

Gift cards and reorders

Your name, contact details, the chosen amount or product and, for a reorder, the photo you upload or mention. Basis: performance of the agreement.

Photos and videos

During a shoot we make photos and videos of you and your family, including children. We use them to create your gallery and deliver your favourites. Basis: performance of the agreement.

Portfolio, website and social media

We only use your photos and videos for this with your permission. For children, a parent or guardian gives the permission. You choose Yes, No or I don’t know yet. With No or I don’t know yet, we do not use them. You can withdraw your permission at any time, without any effect on your shoot. Basis: permission.

Payment and administration

Data needed for invoices and payments, such as name, amount and date. We do not store bank card or credit card details ourselves. Basis: performance of the agreement and legal obligation (tax and bookkeeping).

Questions and messages

If you email, WhatsApp or call us, we use your details to answer your question. Basis: legitimate interest, or performance of the agreement.

Website security

Our forms have a hidden field against spam and we check which website a request comes from. Basis: legitimate interest, namely preventing abuse.

Cookies and technology

We do not use tracking or advertising cookies and no analytics tools that follow you. To make the website work we only store small technical data in your browser, such as your language choice and whether your request was sent. This does not need permission. If this changes, we will update this statement and ask for permission where needed.

Our website loads fonts from Google Fonts. Google then sees your IP address. Some pages also have links to Google Maps and Google reviews. If you click them, Google’s privacy policy applies.

Who we share data with

We never sell your data. We only share it with parties we need to deliver our service. We have agreements with them about protecting your data.

• Hosting and security of the website (Cloudflare).
• Sending email from our forms (Resend) and our email (Gmail by Google).
• Communication via WhatsApp (Meta).
• Our bookkeeper or accountant, as far as needed for the administration.
• Printers or producers, if you order a photo on canvas, acrylic or poster.

Some of these parties also process data outside the European Economic Area, for example in the United States. They must have suitable safeguards for this, such as standard contractual clauses or a recognised data framework of the European Commission.

We only provide your data to others if the law requires it.

How long we keep data

• Requests and messages: up to 2 years after the contact has ended.
• Delivered photos: 2 months after delivery, as stated in our terms and conditions .
• Photos and videos for which you gave permission for portfolio or social media: until you withdraw the permission.
• Invoices and administration: 7 years, as tax law requires.

After that we delete or anonymise your data.

Your rights

You have the right to access, correct or delete your data. You can also ask for restriction of processing, object, or request your data in a common format. You withdraw a permission at any time.

Send your request via WhatsApp or to [email protected]. We may ask you to identify yourself. You will get an answer within a month.

Are you not satisfied with how we handle your data? Please contact us first. You can also file a complaint with the Dutch Data Protection Authority, the Autoriteit Persoonsgegevens (autoriteitpersoonsgegevens.nl).

Children and sensitive situations

We photograph many children and expecting parents. We handle this with extra care. For children under 16, a parent or guardian always gives the permission. We never share photos of a pregnancy or of your child without your permission.

Security

We take suitable measures against loss and misuse of your data. The website works through a secure connection (HTTPS). We only give access to people who need it. Do you suspect misuse, or is something wrong? Please tell us right away.

Changes

We may change this privacy statement. The latest version is always on this page, with the date at the top.
