Terms and conditions

1. Applicability

1.1These terms and conditions apply to all offers, requests and agreements of Photostudio62 (Chamber of Commerce no. 60504285, ABC Westland 259, 2685 DC Poeldijk) for photoshoots, video, studio hire, reorders and gift cards.

1.2A request via the website or via WhatsApp is not yet a booking. An agreement is formed after a day and time have been agreed and the deposit has been received.

1.3Statutory rights that a consumer always has remain in force.

2. Booking and deposit

2.1A photoshoot at Photostudio62 is only definitively booked after receipt of a deposit of €60.

3. Cancellation, rescheduling and arriving late

3.1Cancellations up to 72 hours before the agreed shoot date are free of charge and can be rescheduled to another date in consultation.

3.2Cancellations within 72 hours before the shoot date result in forfeiture of the deposit.

3.3The deposit can be carried over to a new date in consultation, but no refund will be given.

3.4If the client arrives more than 30 minutes late, the photoshoot may not go ahead and the right to a refund or rescheduling lapses.

3.5Photostudio62 reserves the right to cancel or reschedule a shoot in case of illness, equipment problems or other unforeseen circumstances. In that case a new date is planned in consultation.

3.6For outdoor photography, bad weather may be a reason to reschedule the shoot in consultation.

4. Payment and rates

4.1All stated prices include VAT unless stated otherwise.

4.2The remaining amount for the photoshoot must be paid before the start of the shoot, unless agreed otherwise.

4.3Any extra costs, such as travel costs, extra edited photos (€4 per photo) or additional services, are invoiced separately.

4.4Prices and packages on the website are compiled with care. Obvious errors or mistakes do not bind Photostudio62.

5. Usage rights, copyright and licence

5.1All photos and videos made by Photostudio62 remain the property of Photostudio62 at all times.

5.2The client only purchases usage rights and does not acquire copyright.

5.3The copyright on all photos and videos remains permanently with Photostudio62.

5.4The customer may use the delivered photos and videos for private use, such as printing, digital albums and sharing with family and friends.

5.5It is not permitted to use the photos or videos for commercial purposes, advertisements, publications or photo competitions without the prior written permission of Photostudio62.

6. Use of photos and videos by Photostudio62

6.1Photostudio62 only uses the customer’s photos and videos for portfolio, website, social media and promotion with the customer’s permission. For children, a parent or guardian gives the permission.

6.2With the request the customer chooses Yes, No or I don’t know yet. With No or I don’t know yet, Photostudio62 does not use the photos and videos, until the customer says Yes.

6.3If the customer says Yes, the customer receives 5 extra photos as a thank-you gift (value €20). If the customer chooses No, nothing changes about the shoot and the customer does not pay more.

6.4The customer can withdraw the permission at any time via WhatsApp or email. Photostudio62 then removes the photos and videos from its own channels within a reasonable period. The gift photos remain the customer’s.

7. Unedited photos

7.1Unedited photos (RAW files) are not delivered and are not for sale.

7.2The post-processing of photos is done in the style of Photostudio62 and is an essential part of the final result.

8. Studio, location and props

8.1The client is responsible for complying with the studio rules.

8.2In case of damage to the studio, materials or props caused by the client, full compensation will be charged.

8.3For photoshoots involving food, such as cake smash, the client must report any allergies or health risks of the child in advance. Photostudio62 is not responsible for allergic reactions or health problems resulting from food or other materials used during the shoot.

8.4Clients are themselves responsible for the safe use of props, especially small items that children could swallow.

8.5Parents or carers are always responsible for their child during the photoshoot.

9. Video

9.1With some shoots, such as a cake smash or gender reveal, a video can be added or booked separately. The prices and what is included are stated on the page of the shoot.

9.2The same conditions apply to videos as to photos, including the usage rights and the rules on permission.

10. Reorders and wall decoration

10.1A photo on canvas, acrylic or poster is ordered via the website. The price per size is stated on the website. A custom size is on request, and Photostudio62 then lets you know the price.

10.2The quality of the end result depends on the resolution of the supplied photo. With a low resolution Photostudio62 gives a warning, but the customer decides whether the order goes ahead.

10.3Products are made specially for the customer. For products that are made to measure, the statutory exception to the right of withdrawal applies.

10.4Is a product damaged or was a mistake made in production? Report it within 14 days of receipt. Together we look for a suitable solution.

11. Gift card

11.1A gift card has an amount from €50 in steps of €50 up to €350 and can be spent on a shoot or product of Photostudio62.

11.2A gift card request is not yet an order. The gift card is arranged after we have been in touch via WhatsApp and the payment has been received.

11.3The validity and the way of redeeming are confirmed in writing when the gift card is arranged. The recipient plans the shoot themselves.

12. Liability

12.1Photostudio62 is not liable for loss, theft, damage or accidents during or around the photoshoot.

12.2Photostudio62 takes all reasonable safety measures, especially for photoshoots with children, cake smash sessions and pregnant clients.

12.3This limitation of liability does not apply in case of intent or gross negligence on the part of Photostudio62, and not insofar as the law prohibits it.

13. Force majeure

13.1In case of force majeure, such as illness, extreme weather conditions, equipment failures or other unforeseen circumstances, the shoot will be rescheduled in consultation.

14. Delivery, storage and editing

14.1Photos are delivered within 3 weeks after the client has chosen the desired photos, in the agreed format.

14.2After delivery Photostudio62 keeps all photos for 2 months. After this period Photostudio62 is not liable for loss of digital files.

15. Complaints

15.1Do you have a complaint about the shoot or the delivery? Report it within 14 days of delivery via WhatsApp or [email protected]. We respond as soon as possible and look for a solution together.

16. Privacy

16.1Personal data of the client are processed in accordance with the GDPR and used exclusively for carrying out the photoshoot.

17. Changes and applicable law

17.1Photostudio62 may change these terms. An agreement is subject to the terms that applied at the time of the request.

17.2Dutch law applies to these general terms and conditions and to all agreements.
